    San Diego’s city attorney is taking away hundreds of guns from those who shouldn’t have them .
    Under California’s red flag law, enacted in 2014, a law enforcement official or immediate family member can ask a judge to issue a Gun Violence Restraining Order if a gun owner is feared to be a danger to himself or others. If the order is issued — and it almost always is — the gun owner’s weapons will be seized by law enforcement for up to a year. After a year, the restraining order can be renewed.
    In Sacramento, legislation is pending that would expand California’s statute.

    One bill would extend the length of the firearms restraining order from one year to five. The measure, AB 12 by Assemblywoman Jacqui Irwin (D-Thousand Oaks), has passed the Assembly and is in the Senate. Democrats support it. Republicans are opposed .


    Another bill, AB 61, would allow an employer, co-worker or school employee to request a restraining order.

    It depends on the specifics. We allow temporary restraining orders (TRO) to be obtained in emergency situations in ex parte proceedings - meaning without the defendant's appearance in court and even without his notice. The key word is "temporary." If you want the TRO to stick long term or permanently, you need an injunction, will requires full due process rights. The defendant has to be served and given the opportunity to appear and defend himself in court. If these GVROs are lasting for 1 or 5 years and are being obtained in ex parte proceedings, I could see a federal court striking them down.

    One year does not meet my definition of "temporary"
    And the new bill that passed the Ca house of 5 years without due process ??

    Since the word temporary does not appear on the name of the policy how can they get away with it being for a year?

    Scenario:

    You feel threatened and warn the person you will blow them away if they come to your home. The person who is threatening you goes to court to have your guns removed because you "threatened" them. Then you have to get an attorney and go through the process not to have your guns removed which would make you vulnerable to the original threat which assumes it's not an ex parte hearing as mentioned by Mr. Deez above.

    Far-fetched?

    FY18 HUD budget is $52B. 31% of their budget goes to Baltimore? Or is Lynn Patton, the former Trump family event planner, pulling from all forms of Federal expenditures/programs to make the number as big as possible? Someone handed Patton that number and it likely came from the White House.

    If you are illegal in Ca they protect you in" sanctuary" and provide legal help
    But Americans entrapped in this policy are denied their 4th Amendment rights for at least a year.

    Yes there are people who should not have guns. Give them due process like any suspected criminal or law breaker.

    Good question.
    How long should someone suffer a penalty imposed on them without due process? Maybe it should be the same as a person arrested?
    I know this is not a TRO and is imo more serious than telling someone to stay away from another, plus in a TRO isn't the person being restrained notified and allowed an attorney?

    Requiring a reasonable time for due process would get the weapon out of a potentially dangerous person which is what we want but would allow the person accused and the people accusing the person their voice before a judge.
    What Calif is doing is imo pretty extreme.
