Karen Aston should sue UT

    Smart was retained and Aston was not. If Aston sued UT for gender discrimination and I was on the jury, I would side with Aston. It is obvious Smart is being held to a lower standard than anyone else.

    Apples and oranges. Smart has years left on his contract, but Aston's contract was up.

    I don't understand why everyone is combining the two situations between Aston and smart. They are two different programs and they both struggled this season so CDC is basing his decision off of results and Aston was not producing them. It had nothing to do with gender discrimination or anything. If Smart's buyout was not 10+ million then I am sure he would be gone just like Aston. I for one am very happy that CDC let go of Aston and got vic. Shaka is the coach so can we all just accept it and hope we get Greg Brown and support them:hookem:

    Isnt this all controlled by contract?
    What grounds would she have to go outside it?

    Vic Schaefer is a hotter commodity. Astons contract was up, Schaefer was available. Deals were made and butts were hurt. Case closed. No discrimination just business. And excellent hire by CDC.

    Aston's contract was finished and not renewed. Totally different situation than Shaka. Had Patterson not screwed this University in the first place with this absurd guaranteed contract with Smart he would probably be gone too.

    She could've won a national title this season and still have no standing in court. Once a contract is up, neither party is under any legal obligation to renew/extend period.

    what was her record against Baylor?

    He doesn't beat Baylor and he gets let go at the end of his contract too

    Plus, you don't sue the school that gave you that many years if you want to coach again above the high school level.

    How do you have a case to sue, her contract ended? There's nothing to sue over. Shaka is still under contract and the buyout is huge for basketball. Apples and Oranges...

    It was lost on everyone other than @Dionysus that this thread was never about Karen Aston or her legal standing/chances, but about how the University of Texas demands coaches who compete for national championships everywhere except with men's basketball. The point is Shaka is being held to a lower standard than ANYONE. As a Texas basketball fan, I wish more Texas fans would be more vocal in demanding to have a competitive program like they were when they wanted Barnes gone. I find it odd that many of the same people tired of Mack Brown and Rick Barnes seem to accept Shaka Smart's mediocrity and go "oh well". I wish everyone had the "oh well, we do not care about basketball" attitude with Rick Barnes and he was still the coach.

    Now that Fenves is gone, maybe there is hope.

    I dont think that CDC's stance was one of "oh well" but more so one of practicality. Looking at the two programs' prospects for next year (including their returners/incoming recruits) plus the respective contracts (or lack thereof) it is hard to imagine that most, if not every AD making the same decision.

    A conservative estimate of money Shaka would've been owed on his contract, plus the buyout of the new coach plus whatever increased salary that would've required to land them puts that price tag in the neighborhood of $21 million. Juxtapose that with the $3.2 million it cost to replace KA with Vic Schaffer and its clear we're not talking apples to apples.

    For all the money we generate as an athletic department, with the downturn in the price of Oil (some of our biggest donors have fortunes tied in the industry) + the downturn in the market as a whole + the endzone renovation + the construction of the Moody center, he would be foolish to spend that extra $18 million right now after MBB finished the year the way they did and add the best frosh PF in the country on top of returning the entire roster.

    I might not use the word practicality, but instead reality (financially). when you give huge/long extensions, you're stuck with whatever. Shaka came in as a potentially GREAT hire at the time. and his extension wasn't totally crazy at the time.

    if CDC changes to shorter term contracts, do we get a great coach? i wonder. Beard is the only (needle moving) guy who might have moved over on a shorter leash because of his allegiance. The timing was off though.

    it's a hard balance.

    If UT's attorney or the judge caught wind of your bias, you would be stricken from the jury pool & would read about it over a cup of coffee (or adult beverage of your choice) at a later date.

    I used to love college basketball. However now it is aweful. The last game I remember really enjoying was when Danny and the miracles beat OU. Last UT team I enjoyed was with Terremce Rencher. Dam shame when all but one of the best coaches in college basketball is a piece of dirt.

    I used to enjoy college hoops a lot more, but this one and done thing is killing the sport for me. I would rather have the G league or NBA take most or all the top one-and-done talent so we can watch players develop over 2-4 years and create some stability.

    Just look at us as an example. We've gotten some of the best talent out there but because they mostly leave after 1 or 2 years we seem to literally start over every year and Shaka has no idea how to lead a team in these circumstances. Heck, I'm not sure many college coaches know how to coach this way

    I understand some have excitement over next year's prospects because we have a crap ton of talent coming back. I'm not sure if that talent is really being developed so I'm cautious and pessimistic, but this is what would be awesome to have every year.

    Shaka's contract length and extension were absurd at the time. Charlie Strong only got 5 years for football. Shaka got 7 to begin with guaranteed and it was extended to 8 for having the same season that got Barnes fired. That was totally absurd.

    2014-15 - Texas 20–14 - Lost in First Round of NCAA Tournament as a lower seed to a higher seed.
    Rick Barnes fired.
    2015-16 - Texas 20-13 - Lost in First Found of NCAA Tournament as a higher seed to a lower seed.
    Shaka Smart's contract extended to 8 years and given a raise.

    Shaka has made more every year here than Barnes ever made in any year here. I think Barnes, who at Tennessee has outperformed Shaka here, should sue for discrimination as well.

    P.S. If you want to foolishly waste time "analyzing" why Rick Barnes cannot sue UT (statute of limitations, sovereign immunity, etc) instead of getting that this thread is about how UT accepts bad coaching from Shaka and no one else, I cannot help you.

    I guess we can celebrate the fact that Shaka has outperformed Kaiser Bob. However, I will argue that Kaiser Bob faced much stiffer competition in the old SWC than Shaka has faced in Big 12. Show me one team that Shaka has faced that compares to the UH teams during that era. Arkansas, SMU, and Texas Tech all had pretty good squads if memory serves me (normally it does not so someone will surely correct me).

    Hiring differences. Deloss finally got Weltlch to accept the job after every breathing coach above middle school level had rejected us. It was so bad that I told Deloss I didn't care who it was, find someone that would accept the damn job.

    In Smart's case, Powers went after the supposed "hot commodity" as long as he was black.

    I could never complain about Kaiser Bob because of the message I delivered to Deloss. Did I expect Smart to make the Final Four? No, but for that obscene amount of money I expected an occasional Sweet Sixteen.

    In fairness, I actually did think Smart would do okay when he was hired. However, after year 3, it was clear the hire was a dud.

    The illustrious NIT, the last time it was held. It’s a very big deal—the oldest post-season tournament in college basketball.
