    It's simple: regardless of how a situation came to pass, just accept it regardless of the means used to create the situation. As we all know, politicians never lie or cheat, and they all do the right thing all of the time.

    Why should I do the legwork to disprove @Horn6721 's claim? Shouldn't the person making the claim have to provide evidence to support their claim? That's how ignorance persists, the kind that resulted in "patriots" attempting their coup.

    Are you the team member that relies on everyone else to do the work on a project then basks in the glory of the groups success?

    Yeah, lawyers never file frivolous bullshite lawsuits. Maybe they could go with an impeachment of Sidney since that just requires a mish-mash of morons and a vote.

    The smarter ones do for their own sake and for the sake of their clients. Fortunately I never had a claim made against me, but I was insured in case I screwed up. I've known smart lawyers who committed malpractice just by overlooking or forgetting something. We're all human and can make mistakes.

    Seattle I'm with you on most things but not on this.

    Biden won't go out and say he's for open borders, but this is what he'll do after inauguration day:

    1. Anybody who claims asylum at the border gets to live in the USA until their claim is heard.

    2. The agreements that Trump signed with Mexico and central american nations to cooperate with immigration flows are going to be abolished.

    3. Going to revert back to Obama's policy of only deporting violent felons. Anybody else without a criminal record gets to stay and "check in" with ICE periodically.

    This is a de facto open border policy. Because all you have to do is make a fake asylum claim and you get automatic admission to the USA. And when you lose your fake asylum claim, you still won't be deported anyways unless you are convicted of a violent crime.

    The vast majority of immigrants are not violent and have no criminal record, therefore I'd estimate that 95% or higher will fit Biden's criteria for leniency on deportation.

    So a policy which results in 95% of immigrants being allowed to stay in the USA is in fact an open borders policy.

    So if there is a malpractice or liability insurance involved they would have a say in how the Powel defamation suit proceeds? $1.3B is a headline.

    No. That’s probably not a Professional Liability claim. What exactly is the claim about? It might fall under a CGL policy, but intentional acts are usually not covered.

    Regardless, it’s unlikely that the policy has a limit above $1million.

    Let's make a distinction here. Powell isn't being sued for malpractice or any kind of professional liability. She's not getting sued by a client but by a party that was always adverse to her. I don't see her professional liability insurance covering her.

    To be covered by insurance, she'd need some kind of liability insurance beyond malpractice insurance. Furthermore, it would have to cover defamation, which is an intentional tort. Most insurance policies don't cover intentional torts, but some might cover defamation. It's kind of a weird intentional tort in the sense that it's possible to do it accidentally. I should know this with certainty, but to be honest, I've never had the issue come up and never had to know. (@iatrogenic would likely know, so I'd defer to him on this.)

    If insurance does cover her, the carrier would have pretty broad control over her defense including the right to settle the case even if she wanted to "fight for the Kraken."

    And this is the other side of Trumpism and a big reason why Trump won the first time. Democrats have sorta polarized on the illegal immigration issue starting with Hillary Clinton's promise to end all deportations of non-violent criminals. (For all the flack Obama took, he wasn't an open borders guy the way Clinton and Biden are.) The public should not have to choose between Trump and de facto open borders. I think that Hillary would have won had she simply stayed the course with Obama.

    I once handled a case for an insurance company in Texas which paid six figures on a defamation claim under the homeowners policy, which included coverage for personal injury. I don't know if the insurance industry has had their firm in Austin (the Texas legislature) cure this problem for them but the jerk involved (my client) had a big excess policy as well and that may have been where the money came from.. Years ago. And the slander was both intentional and untrue.

    So you represented an insurance company in a claim and don’t know which policy(s) the claim was paid under? That’s...odd.

    My guess is that they'd go to the Texas Supreme Court rather than the Legislature. They've already gotten them to say you can't legally submit a claim under your uninsured motorist policy (and therefore trigger a duty to pay under the insurance agreement and arguably the Insurance Code and the duty of good faith and fair dealing) without a judgment determining liability and damages. If the court will do that, it'll do anything the industry wants. They're dirtier than the filthiest Nuevo Laredo hooker you can imagine.

    Singer Stevie Wonder, who supported and campaigned for Joe Biden, is using the Martin Luther King, Jr. holiday to urge the president-elect to create a truth commission whose goal would be to investigate inequality in this country. But he said the commission will also hold accountable those “who promote lies and false truth.”

    “Without truth, we cannot have accountability,” the singer said in a video posted to Twitter on Monday. “Without accountability, we cannot have forgiveness. Without forgiveness, we cannot heal.”

    He added: “Those in leadership who won’t or don’t acknowledge the truth should be held accountable.”

    “We must define the truth in the facts that support them and declare them absolute. Those who promote lies sand false truth must be held accountable. It is the only way we can move forward.”


    Biden responded with "Hold on just a damn minute!"

    He's saying it now isn't he? But "paying taxes"? How many of them will be paying taxes? And how many will be part of the criminal element? I have no problem with honest hardworking people coming in and paying taxes, but letting anyone in can have a horrible impact.
