WTH? The Penn. Secretary of the Commonwealth (State ) openly says she will ignore the US Supreme Court ruling? And she hasn't been fired?
Without looking into PA statutes, I don't know if they can be unilaterally removed. And, until the cause of action formally exists, I don't know that they COULD remove her without having to pony up a boatload of cash for 'wrongful termination.' But otherwise, yes...I agree with your overall sentiment...sometimes getting crappy government officials out of office just isn't that simple though.
mb Sorry I thought I had added the link Pennsylvania to Ignore Supreme Court’s Recent Order Regarding Illegal Mail-in Ballots - USSA News | The Tea Party's Front Page.
I meant the removal from office. It isn't usually as simple as the Governor summoning someone to the office and saying 'pack your sh*t.' And until they actually DO ignore the SCOTUS, the cause of action for malfeasance hasn't occurred...
Again, I haven't looked at the PA requirements...I don't know if unilateral power exists to do it or if there has to be an impeachment proceeding, and if impeachment is required, whether they have enough votes to get the job done.
But you were able to answer my question, that her just saying she will ignore isn't enough reason to fire her. Too bad
If I told you I planned to go drink 10 beers tonight and drive home from the bar, should I be summarily arrested for DWI before ever leaving work?
DWI? No. Stupidity? Yes LOL... You could go to Specs, get a 12-pack, drive home and still have enough to get another 12-pack tomorrow to do it all over again...and probably STILL have money left over
Oh I agree with your analysis. I'm just trying to illustrate your point about the PA SOS to 6721 in another way.
Sangre I got it and get it. If you told anyone you were going to drink 10 beers and then go drive do you think no one would try to stop you? I hope you see that her refusing to obey SCOTUS has some more serious consequences.
I get it, she should not be fired. SCOTUS ruled that undated ballots can not be counted. but Chapman in reference to the SCOTUS ruling said, " “It provides no justification for counties to exclude ballots based on a minor omission, and we expect that counties will continue to comply with their obligation to count all legal votes.” Every county is expected to include undated ballots in their official returns for the Nov. 8 election, consistent with the Department of State’s guidance. " That guidance followed the most recent ruling of the Pennsylvania Commonwealth Court holding that both Pennsylvania and federal law prohibit excluding legal votes because the voter omitted an irrelevant date on the ballot return envelope.” The "minor omission" is the Penn law required DATE on the ballot. Let me say again OK She should not be fired but surely there is some action that can be taken to prevent the chaos she is fomenting
There is a difference between date on a ballot and date on a ballot envelope You could be right and this could be nefarious. Or it could be that news stories are conflating two separate things.
