Legal recourse against company for losing data?

    I got a letter in the mail today from Countrywide letting me know that apparently a now former employee may have accessed and sold sensitive info of mine. SSN, name, address, etc.

    I am of course going to immediately put notices with the credit bureaus to prevent possible identity theft. My question is what if my identity is stolen anyway as a result of this incident despite my actions and I suffer damages. Is Countrywide liable for negligence in this case?

    Generally not assuming that they have reasonable and adequate measures in place to prevent this from happening. What a lot of companies will do though when this happens is offer some complimentary identity theft insurance to those effected by it as a measure of trying to make thing better.
