The ruling was that some due process check was required. This will be the case moving forward with others. In his case however, he needs to return to have his due process check (in theory). In practice, he will still be found deportable if he returns. Also, Supreme Court has no power to get El Salvador to return him. Remember this is not jail or even a fine. If anything this is more like a civil case or civil rights case than a criminal trial. Thus the incentive to correct a wrong is not very high.I'm confused. I've seen that both sides are claiming victory from the Supreme Court. The Admin says he was lawfully deported and the Supreme Court only said that if El Savador sends him back, they must facilitate his return. The other side says the Supreme Court ruled that he must be brought back by the Admin. Both can't be true and I don't want to be knee jerked in either direction by my own biases.
