Trump Administration Accomplishments

I'm confused. Maybe Deez, MB or one of the other lawyers can help clarify. On the Abrego Garcia case where the Admin deported him to El Salvador and now Judge Xinis wants him brought back. I've seen that both sides are claiming victory from the Supreme Court. The Admin says he was lawfully deported and the Supreme Court only said that if El Savador sends him back, they must facilitate his return. The other side says the Supreme Court ruled that he must be brought back by the Admin. Both can't be true and I don't want to be knee jerked in either direction by my own biases.

So, what in fact did the Supreme Court rule and what affect does it have on the Admin, Xinis, El Salvador and Garcia?

The ruling was that some due process check was required. This will be the case moving forward with others. In his case however, he needs to return to have his due process check (in theory). In practice, he will still be found deportable if he returns. Also, Supreme Court has no power to get El Salvador to return him. Remember this is not jail or even a fine. If anything this is more like a civil case or civil rights case than a criminal trial. Thus the incentive to correct a wrong is not very high.
 
I am no lawyer, but I believe if El Salvador will release him, the US must facilitate his return. But the SC has no authority over El Salvador and I bet Trump winked at their President and said don’t bother.

This is only an issue because Dems think they can score points on this and somehow use this to slow down the deportations (I.e., their voters).
 

Yes, I watched it. Almost made me puke what that poor girl had to go through.

I also flipped through channels. And, of course the only channels broadcasting it were the conservative ones. Unfortunately, half of the country will never see it nor the documents on Garcia. The MSM just has to repeat over and over again that Garcia had his due process rights violated by the evil Trump admin because they are racist and hate immigrants. That's the battle we have.

And Trump is right. Jesus not only came to save, but to tell the truth and expose the corruption of the Sanhedrin. But Caiaphas was the Jewish MSM of 2025 years ago.
 
I hope the TennHP at least took the suspected illegals into custody and turned over to police but doubt it

The Court said little. Very short order. It affirmed the district court's order that the government "facilitate" Garcia's return. However, it expressed caution at the court's order that the government "effectuate" his return, because it could intrude on the executive branch's authority over foreign policy. Basically, the government must make a good faith effort to get him back within the confines of its foreign policy, and it'll have to answer to the district court on the steps it's taking to get him back.

What's all this mean? It's hard to say. Does El Salvador have to turn Garcia over to the US? That depends on the contract we have with them to run this facility. My guess is that the district court can order the government to request Garcia's return but can't order us to use force to compel his return. The judge can also order discovery (sworn testimony, documents, etc.) on the matter.

Legally, it's an embarrassment for Trump. They clearly screwed up and are at risk of being in contempt of court. In addition, the taxpayer is almost surely going to have to write out a check to this MoFo.

Politically, it's a bigger embarrassment for Democrats. They couldn't stand up and applaud the family of Laken Riley and generally seem unsympathetic to them. However, a Democratic senator is willing to personally fly I El Salvador to check on the well-being of a guy who's at least an illegal alien and may be a criminal gang member. It's not a good look.

I know you are right. From a legal point of view Trump Admin did make a mistake by not deporting Garcia earlier before the activist judge got involved
but This? "Legally, it's an embarrassment for Trump."
With whom is Trump or anyone in his admin involved with this case embarrassed? Certainly not the average American voter

Your points on Dems being embarrassed are spot on. Wonder if Van Hollen wishes he hadn't gone especially after all the new info on illegal Garcia has come out?
 
Who’s fighting? Rearranging trade partners isn’t fighting. Did they think they control the US? Maybe under Biden.

It is a trade war. That is how everyone outside the US sees it. At the same time, China is willing to enact large tariffs and participate in a trade war because they hate their own citizens. That is what happens with One Party rule. It is worse that Two Party rule, even though Two Party rule sucks too.
